Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

I really like playing nes roms on my ds, wish i could find a real copy of smb 2 that worked in nesds as i recently discovered that the game i thought was the second was a lie! Would be really cool that if you purchased classics on the 3ds you could modify the depth of the sprite layers and create som basic 3d:)
first off you can tell from this guys tone that he doen't really like 3ds and wants it to lose to psp2.he sounds like a hardcore gamer cause he knows how powerful the not officially announced psp2 will be!and he complains about the 3ds price and doesn't mention psp2 being probably more powerful than 3ds and having cool new features that it will probably be priced around 3ds or cost more than it.and if he would do a little research nintendo always lowers the price of there hardware for america and people thinks going to cost $250 dollars making it expensive but more reasonable for what it does.and when wii launched in japan it was the same price as 3ds is launching with and it didn't come with wii sports so we got a way better deal here.and he says systems with a good lineup of games sells well and 3ds has the best launch lineup for a nintendo system and it's got great features to justify it's high price. so lets give 3ds a psp2 a chance to launch before we get down them for a nice change!
Don't people get the concept that home consoles are home consoles and handhelds are handhelds...its like people getting chocolate in my peanut butter sure it may be good but is gonna cost more and I for one am not looking for a $400+ price tag for a handheld system that has wii/ps3/360 graphics.... not to mention the 3ds is crazy powerful for a portible and I am sure the psp2 will be nice as well but nintendo has owned the market for years....
Sony would need to get a jump over them and release a handheld before nintendo to take some of its market away like the 360 did to the wii and ps3....
handhelds are ment to be cheap and fun I loved having a ds and playing castlevania or a psp and playing portible ops and gta liberty city storys and vice city storys
