The claim seeks compensation as a result of alleged defects to Firmware 3.0, which was made available for download on or about September 1, 2009. The defendants named in the lawsuit are Sony Computer Entertainment America Inc. and Sony of Canada Ltd.

Look I know VIII has its issues and all that but how on earth can the do big anniversary events with new artwork and merchandise for VII, IX and X yet VIII got sweet f*** all.

Yeah I can see that for sure. Shuhei Yoshida should have been in charge not Jim Ryan.
More confirmation that Jim Ryan is the culprit for what has happened to Sony. Hulst needs to go too. What sucks is that a lot of the good top heads at Sony are no longer there. I wish that guys that were forced out prematurely by Dumbo Jimbo like Shuhei and Layden came back.
Makes you wonder if MS even thought about hiring him after Phil and Sarah were leaving. He certainly couldn't make their situation any worse.
All the gamer/consumer lead heads are gone across PS and Xbox. shuhei gone phil's gone (questionable) but gone. The future of gaming is somewhat uncertain across the board.
I think thats pretty reasonable.
its pretty clear that 3.00 ruined the ps3's so sony should pay for that, if after your warrantly the hardware goes wrong just out of bad luck then fair enough.
But sony created and distributed a piece of software which broke ps3's, not intentially but the blame completely lies with sony, and so at the very least consumers should get a free new ps3 in return.
But don't you have to agree to the license agreement before installing it--the one that says sony is not responsible for damages?

To clarify, wouldn't this mean it can't hold up in court (whether-or-not sony should replace/repair the units)?
