OMG, MS must have known that the patent would have held up in court, for them to pay the money. Either that or they wanted to settle ASAP to make sure Halo ODST doesn't get tainted by the lawsuit.

90 Mil is ALOT. They had to have thought that they had no chance...I mean..even with the Immersion lawsuit (rumble), they fought it out. Not good at all. That's almost double the cost of the two GTA dlc's!...man.

Best to be the first to pay then the second,third or last. They had no chance of winning because they STOLE. They should have paid in the first place, and so should other companies. They are making money off of someone else's invention, and paid them nothing. This coming from companies that are themselves suing us for stealing? Hello! As a computer programmer I know it is EASY to prove coping. I can write a program, and tell you EXACTLY what it will do. And 1,000 other programmers can do the same, even though they do exactly the same thing, NONE WILL MATCH(have the same code)----NONE. That is with a simple program. This was complicated one! Even less chance of matching. They had no chance of winning. They should not win, own up, and pay! It is easier to get away with coping hardware then software. I said that they should pay when this store of the suit was first mentioned. That was fast! Where are all the people that dogged the inventors for wanting justice? Call them whiners huh? Why did they wait huh? Now you see why 90 Million smackers if they had done it on day one they would have gotten way less. And other companies would have made a concerted effort to change the code dramatically when coping. Now it is too late haha! Go mpath!

Oh f-ck off indysurfn. You have absolutely no idea on the broken hideous nature of American patent law, the whole system, especially regarding software patents is fundamentally broken. Ebay's "Buy it now" button was patented, and they had to fight for years, and eventually pay up out of court.

Because the cost of just paying the plaintiff is less costly than fighting your ground. From a pragmatic point of view it's easier for a firm to just offer up dirty money instead of seeking justice. Note how that this case was filed in East Texas district, because they have a history of awarding dubious claims to plaintiffs. Marshall, Texas, has an entire industry set up to cater for litigation, it's economy depends on it being plaintiff friendly. And if you're an IT professional, you should be familiar with The Register, the de-facto IT news standard. Maybe Microsoft did infringe on the patent. But no one will ever know, because the whole system is broken. Don't shoot your mouth off with crap like "MICROSOFT STOLE", when you have absolutely no idea of the bigger picture.

There is no proof Microsoft stole these patents, infact the article even states the company that was sueing Microsoft bought the patents from another company for 200k, they had no hand in their creation.

Man forget these people! They dont deserve crap! I am obviously in the wrong business. What I need to do is buy patents and then wait until a game company uses it and then sue them for millions of dollars! How can they even let these pieces of crap win! I hope paltalk goes out of business in the crappy economy! You may think they won this time, but let me tell you that Karma will come back to bite them in the ass!

So you're saying big corporations like MS and Sony have the right to basically steal from smaller companies just because they can? I say let the courts decide who's right or wrong and how much is a reasonable payoff. With all of the money and attorney power MS has, it's obvious MS knew they were in the wrong. That's why they settled.

No mpath did not invent it but obviously the original inventors did not have enough money to sue Microsoft. So they bought it from the INVENTORS, thus the inventors got paid(finally). And usually you get a percent of a settlement plus a up front non refundable fee. So go mpath. I may have to use them one day!

This is an obvious case of a company trying to get money. We need a reform on the patent system. It is ridiculous when companies like amazon.com can get a patent on 1-click ordering.

Software patent shouldn't be on the result, but rather on the implementation. If the idea holder wants to patent it, let him come up with the multitude of ways to achieve this and document it.

All you need is an idea for a patent. If you know that eventually a large company is going to do something say wireless controllers, you can get a bunch of patents on "methods" those controllers use to connect to the console. Then you wait five years doing nothing until you notice that for the past two years Sony and Microsoft are using the idea you never put into production. So you sue them. Does that seem fair? The patents being filed today are so broad and ridiculous, lawsuits are everywhere. Big companies are also doing this like Microsoft and custom music in games. That took one second of thought to come up with and should not be patentable.

No I am not saying that Msoft has the right to steal from smaller companies but that is not the issue here! The smaller company is stealing from Msoft in this one. They are what is known as a patent squatter. They buy a patent and sit and wait until Msoft and sony and nintendo have been using it for years and then they sue! This has happened to each and every company and it is not right! Sure it may be legal but it still wrong! They need to change the patent system. Make it harder to create a patent for every silly little thing that pops into people's head. People take an idea like the wii remote and they think of some way that they can "improve" it and they patent it and wait to see if nintendo does something that violates their patent. I mean it happens all the time. And yet you have thrid party companies like madcats that are allowed to make crap accessories and sell them and they can never get sued! The system is flawed and until they fix the system more and more small companies will take advantage of the money that the bigger companies have. If you ask me this should be the same thing as money laundering!

We've seen developers in the AAA space try new things and ideas. More often than not, the customers aren't willing to give things a chance, or not enough people buy into the project for it to grow.

Creativity works better in the indie space because the budgets, pressures, and expectations aren't the same.

it's a nice idea and it worked during the PS2/PS3-era when AAA didn't cost hundreds of millions of dollars. smaller budgets and shorter development time left room for more creativity and more risk. a game didn't need to sell 4 million+ copies to break even. things are different now.

This is the guy who bragged about crunching his staff and having them work through the night. Crunch culture has lost more talent and done more damage to the industry than any other factor. Screw him.
