Could Nintendo Sue Over Temtem?

Temtem comes close to infringing on Pokémon's intellectual property, but does it come close enough for legal consequences?

I'm sure Nintendo would love to, I mean I wouldn't want my multi billion dollar franchise getting shown up by an indie dev, but there's nothing they can do, well besides tell GameFreak to get their act together.. OR give Pokemon to a competent developer.

pretty sure Nintendo is perfectly fine with the sales of Sword and Shield. It's good that we have more games in the vein of Pokemon. Stop acting like Nintendo isn't reaping in huge amounts of money here.

@Neon I never once said Nintendo wasn't happy with the sales, if ANYTHING me pointing out it's a multi-billion dollar franchise was me saying they are making way more than enough money. (And then not putting it back into the series) My entire comment was focused on quality of the games, Nintendo has never went after other projects from a sales standpoint, they have taken down plenty of small projects that would never effect their bottom line.

I was simply saying if I was Nintendo I would be embarrassed that my multi billion dollar franchise is being put to shame by indie devs.

If it's all original content then they cant do anything. Even if they copied the game play, so long as they wrote their own code, nintendo cant do anything. You cant actually copyright genres...as was put into precedence when that PUBG guy tried to sue epic.

Now if they had knock off content which closely resembled copyrighted or trademarked characters...like say pikachu, then there may be a case there. But a cease and desist is more likely, at which point it's in the content creator to pursue their rights to keep it.

Question is...does nintendo care if another company makes a similar game? So long as it's not trying to infringe on their own work, there is nothing out of the ordinary taking inspiration from other work. Hell, much of the 8 bit era was inspired by nintendos work

In any case, its not on nintendo to sue. Nintendo is just one of the pokemon license holders.

Why? For showing people how much content and features you can give people if you actually try...it's only a small team aswell. Imagine what they could achieve with a budget like Pokemon gets.

Logyoof2318d ago

It's an MMO, so yeah, it probably should have more content than a single-player game lol.

Question is, how long can they keep this up? MMO market isn't an easy one and only a handful are still on their two legs. Even so, clearly Temtem is being over-glorified because people are upset with Nintendo.

As if a lot of Nintendo’s own systems don’t take heavy cues from other franchises

AspiringProGenji2319d ago

I heard Nintendo created the internet too.

CBaoth2318d ago

nah that's Al Gore, but they did invent rollercoasters, lollipops, and rainbows. So there is that.

Playwrite2319d ago

This is a nothing story. It's already been dealt with and Nintendo is not suing:
"Are you going to get sued?
We're not using any patent or copyright from Nintendo. Switch already has several games very inspired from other Nintendo games (Brawlout, Wargroove, Oceanhorn...)."

ZeekQuattro2319d ago

It's being ported to the Switch. Why would Nintendo turn around and sue them? Lol
