Hines: We Didn't Have Much of A Choice, We Contacted The Prey for the Gods Team A Long Time Ago

Bethesda's Pete Hines said that the Prey for the Gods team was contacted a long time ago, even before their Kickstarter campaign, about the trademark issue but they strangely decided to bring it up just as Arkane's Prey launched.

He also said Bethesda didn't have a choice or it would have risked losing the trademark, and they had to change name many times for their own games due to the same regulations.

I get that trademark law is in dire need of some updates, and ZeniMax would struggle to defend it's trademark if it didn't go after Prey for the God's but seriously!? It's so stupid. And I bet Bethesda won't get nearly as much flak as King for its little 'Saga' affair a few years ago

Good question. For once, most of the blame might actually be on the indie developer as they probably decided to make this public exactly when Prey had the most media attention, which is on launch day.

Knowing Fox a bit, I feel confident in saying that he meant "Why didn't Bethesda call this game something other than Prey?"
I know this, because he and a lot of people felt the story of the last Prey game was left unfinished. Coupled with the fact that Bethesda said the devs could make what they wanted, but it had to be called Prey.

Because they are the ones that own the trademark? And the ones that bought the rights for the IP(even if they ignored the previous game)..

Isnt that more than enough reason?

Or just let it go because a word used in a sentence for a title in no way dilutes the trademark of a game with a single word title. This is because most people actually can read, and Prey is a word that is descriptive and meaningful, and single words should not be allowed to be trademarked beyond their actual IP, so that the word can not be used in any way anywhere else.

They already settled on a solution. This was more of an explanation about how trademark law doesnt really gives them any other choice but to fight otherwise they risk losing the trademark
