gamesradar is citing an old ubi-forum comment from Natchai ( http://forums.ubi.com/showt... He already clarified that they aren't punishing exploiters but will find ways to punish future exploiters. There are no bans and my guess is they may ban future exploiters for max 3 days as they do with cheaters.
As for the code of conduct: I can not remember signing off any code of conduct after starting the game for the first time. This code of conduct is a supplement on their official website. Unless they make us agree to it ingame, I would think it means nothing legally.
The Division is only a problem on PC, a big one at that. I'm predicting that consoles will be under complete control in the next couple months.
