Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

LOL I read this on gaff, will they refund the money back to the gamers? highly unlikely. Didn't they just raise prices and pass it onto the gamers? Only Nintendo would send out the Ninjas to the US government.
It isn't necessary. Nintendo needs to focus on 3rd party exclusives. For example, I wouldn't be surprised if they purchased Capcom. That would be an industry changer for them. Hardcore gamers would switch ASAP in my opinion.
New IP isn't Nintendo's answer to everything. Even with Splatoon boosting Wii U sales, it eventually fell back to weekly hardware sales lower than even the Vita.
Even many of Nintendo's longrunning franchises such as Super Mario, Donkey Kong, Super Smash Bros, have only provided a small bump in sales when they released, only for sales to go back to subpar afterwards.
NX could have the same thing happen to it.
It really does boil down to games, whether old or new, third party or first, Nintendo needs games.
I would like to think the well has run dry on the Wii U because it was pronounced dead internally before Christmas 2015. Everything they have done has only served to squeeze every penny possible from the system. They are hedging their bets on the NX, saving games for a stellar launch lineup.
That's what I am hoping anyways.
Fire Reggie, make technology more in line with everything else AT THAT TIME, implement current technology trends in your console, overhaul your network infrastructure, attract 3rd party devs. (fire everyone in your company and higher half western and half Japanese devs/managers/people who have worked in the industry external of Nintendo).
