Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

If Nintendo is smart, they'll sit back and see how things play out with Sony's VR release. It's usually those who come after the pioneers, bringing a superior product that make the real money from an idea.
Just focus on a good console first.. let it do well. Then worry about VR.
Don't bite off more than you can chew right now Nintendo. Things might finally be heading in a good direction with the NX. Don't complicate things too early on.
