Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

We don't even know when it's coming out, for all we know it could come out in 2018, devs will get them when the console is closer to being finished.
I know Indies need the kit, but I also know there are development kits out there for large 3rd party companies. Perhaps Nintendo feels Indies have a greater chance of leaking? I also think NX will release this year.
They are not hiding it. Bad bad bad article. A butthurt dev says something stupid about Nintendo that other devs have said he should feel embarrassed about and now it is nintendo's fault?

Two developers said something. On top of that indie developer is more likely to leak into. I'm one to believe that games can easily be brought up to nx standards without a lot of effort. Lastly I believe this person isn't mad for Indies but because they are looking for information themselves.
