Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

Personally I love the way CD Project Red is doing it with Witcher 3. Patches and Feww DLC for the first months and than a couple of relative big DLC at a point when the most people played the game through and stopped playing it.
This line was hilarious: "Call of Duty releases map packs, weapon packs, skin packs, voice packs, back packs, snack packs, all packs, and guess what? You’re going to have to pay for each and every one of them."
Nintendo has made all their DLC not only priced right or FREE this generation. But so damn awesome! :)

Free DLC for a multiplayer focused game is fantastic, especially free maps. It keeps the community alive and unsegregated.
