Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

While as a Nintendo fan I highly doubt it can become the highest selling console this generation, I WILL say that it's far from being dead.
Anyone looking at its 2015 releases can easily tell:
- Splatoon
- Yoshi's Woolly World
- Xenoblade Chronicles X
- Starfox U
- Zelda U
- Devil's Third
- Mario Party 10
- Mario Maker
That's 8 exclusives coming out and there's 9 months left in the year (it's basically March in a couple days!).
Gotta admire the optimism.
The perception online is that, if a console isn't leading the market in terms of sales. It has failed.
It's funny, the Wii U isn't selling the best, but It probably has the best first-party offerings.
Strip the other two consoles of third party support. . let's see what you're left with ^_^.
