Atari failed because their new owners after the crash were only half-committed to games. They wanted to be a computer company, and at the time the thinking was you couldn't be both.

Then when the game console market became lucrative again, they just dumped their old stock of consoles onto the market, making half-hearted attempts at new-IPs and never doing enough marketing. It wasn't until the Jaguar that they produced a console that wasn't simply a rehash of existing Atari products. But again they didn't do enough marketing to make it a success. They folded soon after and became just a brand that started changing hands like a hot potato.

Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.

Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.
