Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

LOL I read this on gaff, will they refund the money back to the gamers? highly unlikely. Didn't they just raise prices and pass it onto the gamers? Only Nintendo would send out the Ninjas to the US government.
I think a single player focused 3D Mario game will release for Wii U before the end of its lifespan. Super Mario 3D World was incredible and the view worked pretty well (sometimes depth perception was hard, that's about it) but I expect the single player one to have the traditional 3rd person view.
I think it would be nice to have a 100% open-world exploration game with a main quest and countless side quests that you can complete in almost any order you want. That would be awesome.
I definitely think touring around Peach's castle needs to return in some way....but as far as power ups, this needs to return with all it's abilities:

Just put galaxy back in the title and a number 3 health meter was in galaxy so that would be that sorted and Id prefer it more like galaxy 1 or mario 64 more so where you have to find the levels in the different paintings like that chap in the article says open world as such, but yeah Mario games even some of the "New" weren't awful nintendo never seen to do deliver a rubbish game normally pretty spot on and every now and again or generation or so they blow it and everyone else out of the park but I won't lie I'm yet to play 3d world on wii U I will I've got it sat here but I'm still to finish the launch day one haha and then luigi plus I prefer dogs but i will play it but I won't lie if a new mario galaxy 3 came out it would get jumped right to the front of the queue ;)
