Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

Ports from indies are on the rise [Ittle Dew just got released, in fact, so I'm picking that up today], and it's got a few really nice exclusives from third parties under its belt.
It's not just a Nintendo machine anymore; the offerings outside of first party have actually gotten quite good.
It's suffering from a huge lack of effective advertisement and a lot of really lack-luster AAA third party ports, though.
If Nintendo wants to step up their game plan for the Wii U, they need to get in touch with big name third parties and convince them to do some exclusives that will appeal to older gamers, then market the hell out of them, instead of relying on multiplat ports from a small number of AAA third parties that likely won't even have all of their content, let alone the same amount of effort put into polishing the Wii U versions...
