You're underestimating the average age on this site. The average gamer is like 20 something to 30 something (depending on what study you look at) and I can't imagine that a gaming community is that wildly off from the average. No need to further the stereotype of gamers being children.

He even got 21+ agrees and a "funny" bubble, clearly a lot of these "kids" DO know what Colombo is.

So when you have too pay(if you have an SNES) sometimes over 200USD for each of these games Secret of Mana, Chrono Trigger and such too get them for the original systems. No way no one would pay that execpt the true fanatic of those games.
But why should for example the owners of those who bought them in the past have too pay for a converted copy to Virtual Consoll they already own the game.

Second the emulators does more for the games themself then it´s original system. Take the Dolphin emulator that enhancing Gamecube and Wii games to thier fullest potencial. To play those games in 1080p with great upscaling.
Why did not Nintendo incorporate these features in Wii U whithout us have to pay a single penny for it. I do not think for a second that this BS.From either Nintendo, Microsoft or Sony that thier systems is not backwards compatible "not for a second". I mean, What could those emulator makers do with OXBOX. The could make OXBOX run Sonys system Playstation game on it. If they could do that too that system(often singlehanded) Those companys can do it too. They are just being stuborn, greedy, or nonlistening to what we gamers really want from future systems.

Hate to break it to you but emulators ARE NOT illegal, most don't even have a shred of the original code involved (although some do require the BIOS) and as such are classed as the coders own work.

Of course Nintendo are going to say something like that, they're the biggest lobbyists of anti gaming piracy around.

Roms/backups aren't illegal either as far as its a backup from your disk/card and not from someone else its basically the same than ripping a CD/DVD, as far as you don't distribute it its not illegal and this is why Microsoft came with the Xbone policy that you own the disk but not the content.

I thought you had to have proof of purchase i.e. reciept of original copy?

I sware the DMCA has some kind of stupid clause now. I think a personal back-up is still authorized if it falls under fair use i.e. you don't share it.

However, it seems they keep amending the DMCA each year that it's hard to keep up on how they determine "Fair Use".

You can make a copy of your personal copy of any media available. For games however, it is usually not within the terms of service to be able to use that backed up software on the original device it was intended for. The software itself is also not typically licensed to be used on a device other than the one it was written for(or compatible devices in the case of backwards compatibility). This is why Nintendo can get sanctions against those cards which hold roms, because they're intended to work on one of their devices and it's not licensed to do so. Same with mod chips, although they themselves are not illegal as it isn't illegal to modify you're own brought hardware. It used to not be illegal to play you're own backups with them, but I haven't followed that scene for quite a while, so not sure where it is now. It is certainly illegal to have a copy of something you don't own and use it on a modded system though.

Emulators are a tricky business. The emulator itself is not illegal. However, the bios typically needed to run said emulator is copyrighted work. Thus actually using the emulator to run software is copyright infringement. As far as I know, there is no way to write ones own bios code that has no copyrighted work from the original bios, but I guess it is possible.

Some of these issues have been getting closer looks by the courts over the years as they've finally become more prevalent. To date, the courts have pretty much not taken a real stance on the issue. Last major one was last year when the courts passed down a judgement(can't remember the actual term) that it was not legal to jailbreak the PS3. However that particular ruling has not been tested in actual litigation.

Yeah, as long as it's mostly your own coding, an emulator is not illegal. It EMULATES, it's not a carbon copy of the hardware. Roms are another matter entirely, though I pretty much only get roms of games that I've bought in the past. If it's a game I never got to check out that's 2 generations behind the current one though, I might grab it to see if it's any good. I never grab anything I haven't bought past PS2 era though.

Exactly, they aren't illegal at all. E.g., with PCSX2, the PS2 emulator, the emulator comes with everything you need to get it running, except the BIOS, which you need to rip yourself, which means you need to have your own PS2 to legally use the emulator. Same with games, you need to own the original disc and make your own backups to play them legally.

So long as you own the original console (if a BIOS is required) and you rip your own backups of the games, then you're good to go. If PCSX2 were illegal, Sony would've ordered a cease and desist ages ago. I regularly speak with some of the PCSX2 devs, and they've told me that Sony has been well aware of their work for many years now.

I don't agree with that. I WISH I could agree with that. But buying habits and customer opinions prove otherwise

We've seen developers in the AAA space try new things and ideas. More often than not, the customers aren't willing to give things a chance, or not enough people buy into the project for it to grow.

Creativity works better in the indie space because the budgets, pressures, and expectations aren't the same.

it's a nice idea and it worked during the PS2/PS3-era when AAA didn't cost hundreds of millions of dollars. smaller budgets and shorter development time left room for more creativity and more risk. a game didn't need to sell 4 million+ copies to break even. things are different now.

This is the guy who bragged about crunching his staff and having them work through the night. Crunch culture has lost more talent and done more damage to the industry than any other factor. Screw him.
