
Following a report in Japanese newspaper Nikkei citing Nintendo is preparing a smartphone application that will make available game trailers and mini games based on 3DS and Wii U games, the company has issued a comment that “there are no plans to offer mini games on smartphone devices”.
The announcement for this smartphone application was to said to occur during an investor meeting scheduled later this week. However, with Nintendo denying rumours of a mini game enabled smartphone application, the question on everyone’s mind is, how will the company leverage the smartphone market?

The rejection is non-final (and even when such rejections are labeled as “final”, the process is far from over, given that there can be, at minimum, an appeal to the Federal Circuit).
Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

LOL I read this on gaff, will they refund the money back to the gamers? highly unlikely. Didn't they just raise prices and pass it onto the gamers? Only Nintendo would send out the Ninjas to the US government.
Probably for advertisement purposes and for getting a better feel for the kinds of games that the mobile market is playing so that they can make similar experiences for the Wii U and 3DS.
You know, putting out "feelers" so that they'll have a better game plan for re-supporting the people that went from Wii to Mobile, or something of that nature.
Just a guess, though.
For all we know, they could just be using it for more Miiverse options or for putting out some public opinion polls on various often-visited mobile sites.
