Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

Game looks really fun no mather...But i shure would have liked a Mario "Universe" game with the best from 64 (Still the best I think) and galaxy games.
Nintendo is a masterclass when it comes to game development. Unfortunately not many publishers can afford to give the amount of time and polish as Nintendo when it comes to game development and it shows. Nintendo software has long legs and maintains a premium price in software. Other publishers have to drop the price of their software shortly after release to try and keep the sales moving.
