He confirmed on Twitter that his GT is not banned, just his XB1 console from playing online, mostly likely a temp ban. Lock this topic please.

How do you know it is temporary ban? His console is still banned and he said that his GT has "yet" to be banned meaning he is still not sure whether he will get banned or not.

Personally, if he bought the system, bought the games, and waited patiently but got his console early, he is entitled to enjoy the little hiccup and DO WHATEVER he wants with HIS console.

He didn't sign any non-disclosure form. It is his right to show, and talk about anything he wants regarding HIS console.

Microsoft's being a bit of an *ss for banning in the first place. He was actually doing them a favor. He's excited about THEIR product and talking it up. Microsoft could use a real gamer being excited about the Xbox One. Instead, they banned him.. -_-

MS was not the ones that fucked up to begin with. It was the retailer. Although the customer didn't do anything wrong it would only make since that they ban him. Both Sony and MS are working on just about everything up until launch (except hardware) so any leak of an unfinished product could spell disaster for a company. Even Microsoft agrees the X1 is not a finished product yet.

Common sense would have dictated that leaking and uploading all that info early would have led to a ban though.

Still, it's silly that MS banned him considering that this chap has done a better job at marketing the X1 in less than one day than the whole MS PR team has in 6 months

What @DeanSanchez said is completely right. He has not signed any NDA & has not modified or doing anything at all against T's & C's so he is absolutely well within his rights to sue Microsoft. Not only for wrongfully banning his system but also trying to FORCE their beliefs onto him - what they're doing is illegal. He should do it & he would undeniably win!!

Verge also says, "It’s highly likely that any bans that Microsoft issues at this stage are temporary to prevent details of games and apps ahead of reviews and broad availability."

Just cuz u bought something. Doesn't mean its urs do as u plz. That's how corporations roll these days.

Even if u buy a console, u gotta use it in the way the manufacturer intended it to.

They also can ban the console whenever they feel like.

U have the option to not buy it.

Anyone. ANYONE on the internet who buys an Xbox One and then comes back a few months later crying and b****ing about how Microsoft is treating them deserves not a drop of sympathy. We've had an entire YEAR to watch Microsoft's behavior (several years, actually, if you're smart enough to pay attention).

If - at this point - you buy an Xbox One, it's your own fault.

What's the difference between gamertag ban and console ban? Just asking. Banning gamertag prevents you from accessing online and games you bought digitally on that account (thus achievements, stats and friends etc) but you can create another account and play games you bought in disks. Console banning is preventing you from playing both disk an digital versions of games, not accessing your entire console by any means, in sum throwing your device in garbage. Is that right ? If true then it is a harsh sentence , and what will he do with his still not banned gamertag? Buy another Xbox 720 and use it on it? Imagine his gamertag is activated on that banned console and he can no longer deactivate it and a gamertag has limited number of activations on machines. I think console banning is the worst and enough to make you suffer and I think this is ironical and even cynical : banning his console and keeping his almost useless gamertag, what's the real use if you confiscate my car and leave my driving license to me ?

Common sense would have told him not to expose who he is, or where he is even from. If it was me, outside being anonymous I'd only show maybe the box, the console, and not even have it connected; instead he had to go on the internet and advertise having an early console.

While I don't condone what MS did what he did was stupid; and if nothing else they can argue free advertising.

Couldn't agree more with Dean. even though is a temp ban as confirm on twitter by Lary Hyrb, he should be able to enjoy his system even if he got it early. It's not his fault but Target's. Microsoft better do something about this and i hope to hear he get to play his system before it launches. What a heart braker it must be for him.

yeah he is banned temperally till release date ,ms contacted him and said you will be banned till release at least he can play sp and take use of offline facilities as ms knows that it is not his mistake ,it is news from around the world that some people have also get the console but they are quite because they are using online facilities and ms is allowing them but have been warned if any info leaked or games spoiled they will also be banned till 22nd nov and ms is keeping eye on their accounts and xblive acoounts ,ms dont want info to be leaked because millions have not get the console.we only have to wait for 15th and 22nd november to dicide which is better.

i feel sorry for the guy, he was excited and all but rules are rules and he went against policy..the guy should have known better ..seeing how ms has banned others recently due to similar issues he should have been more careful. i know i wouod have..well i believe the ban will be lifted and he will be welcomed back to the fold on nov22. so sorry dude...atleast you can keep playing those games, just not on xbx live for now...and im very sure most of those making a fuss about this dont even care about the guy or even plan to buy an xbx one..just people looking for every reson to say crap about ms...

If his LEGALLY purchased XB1 was received LEGALLY and MS banned him for using his LEGALLY OWNED XB1, he may have a potential legal action against MS depending on where he lives. He was under no NDA or other contractual duty to MS. Actually, he probably couldn't even use the thing as the day one patch is not available.

Listen, regardless of which side you're on Xbox or Playstation, you have to feel this is anti-consumer. This guy bought a console legally and not by his fault it was shipped to him early. He should be allowed to do WHATEVER he wants with his $500 investment. I would return it.

Call me a fanboy if you want because I'm buying a PS4 this gen but I had a 360 last gen.

Was he naive for thinking Microsoft of all corporations wouldn't do this? Yep.

But it doesn't make what they did right, simply because they had the power to do it.

Walking down a dark street in a bad neighborhood is a bad idea, but if that person gets mugged/raped/murdered it doesn't mean the action of the perpatrator was any less heinous.

TOS are basically contracts where you give your rights away, so legally Microsoft did nothing wrong.

But everyone with a brain and isn't a corporate apologist knows it's morally wrong.

Had Major Nelson not doused the flames this would have burned Microsoft really badly, and would have piggybacked off all the anti-consumer stuff coming from MS this year they backtracked on and in some cases still have in place.

All right after Penello came on the internet and talked about how MS's fascist and authoritarian vision wasn't accepted because MS didn't have the opportunity to explain themselves and that the consumer just weren't ready for a great idea. (so blaming us for their horrible vision).

That's the thing about PS4 owners, many of them also had an Xbox 360. I have like 100 games or more. But somehow people that take Microsoft's abuse feel those that decided not to, are somehow fanboys of Sony. (I'll guess they're projecting their own fanboyism of Microsoft)

I cant decide if this is a good thing or a bad thing. Did he get his consoles from the target issue? If he did be shouldn't be banned unless the ban is temporary which isn't so bad. If I were Microsoft I would message him saying the ban is temporary as the system is not released yet. Sorry for the inconvenience

That's the problem with MS they ban no discussion they don't send an email warning you to take down photos or videos no they just ban you, when people jailbroken their ps3s sony gave them a chance to redeem themselves and they sent each and everyone an email to install authentic firmware and it was a much more serious situation in sony's case not an early console leak.

that's not entirely true... it was rockstar enforcing the bans on both console which they did... some users on the PS3 got banned and same on the 360... sony only said they weren't the ones issuing the bans

technically the man did break the T&Cs by leaking pre-release footage/images of the console (same stuff with GTA5 happened on both sets of consoles)... hopefully MS will have some cop on and unban the console on the 22nd if not they're just begging for bad PR.... also from what i read about it it could well have been some of their best PR in the past few months

The stock mark is what makes Microsoft remarkable, They have convinced every institutional and retail investor to just keep piling money into them. Like many big tech giants they are just a big growing pyramid scheme. As long as people keep dropping money into ETF's that cover the market Microsoft will always be liquid. At the same time it is completely stifling innovation and competition. People need to start being more discreet in how they invest their money as it's killing the system.

These declines are on the back of extra revenue received from releasing games like Forza horizon 5 on PlayStation. So I’m being sarcastic here when I said they should go back to exclusives. Killing off a revenue stream from Ps5 sales will only make things worse

This kind of proves this is an after thought product, most products like this are in r&d 5 years before they start mass producing. So they typically have the cost of components and things worked out long before assembly starts.

This is an assumption still, but I wouldn’t be surprised if project helix is similar to Scalebound,perfect dark and sod3. They had an idea but no actual execution other than concept stage. Being impacted by the ram shortage likely would also put this device 3-4 years out.

I’m not even sure MS has that endurance with Xbox yet

We're at a point that Samsung wont even provide their own phone department ram because they can sell it at higher prices to 3rd parties (AI). Its more profitable to sell the ram than make their own devices with it.

You think because R&D starts 5 years ago the 3rd party component manufacturers will honour that price? They'll sell it to whomever is paying the most today, not some gentlemens agreement they made years ago. AI farms will buy more volume at higher prices than any console manufacturer will. It'll be the same for Playstation.

Contractual agreements are not the same as “gentlemen” agreements. If you think that they work with their distributors a month before production then their entire business model is trash. They work with companies like nvidia constantly for building the graphics cards they need. They work with companies that build motherboards years in advance. This is what proper business planning does.

They are not buying components on a whim like a consumer. So again, considering the ram isn’t a singular module and is integrated into the motherboard I highly doubt they wouldn’t have a final schematic that they are supposed to be building around.

If they are delaying production another 3 years then it’s obvious again this is an after though project and is just trying to be responsive to their bad execution they had the last 14 years.

It also isn’t far fetched to use their failure to produce first party titles the last 7 years including the highly anticipated games I mentioned all being cancelled. That they would continue to you know… lie

Helix is going to be stupidly expensive

Instead of leaning into smarter upscaling techniques they're brute forcing hardware that will cost them dearly and it remains to be seen if it's genuinely going to provide a meaningful differential

I know in the oc.doace people like to brag about not using frame gen or dlss to get to high on a game but for the majority of players they happily use those technologies without a second thought

Another important lesson from this generation: while Nintendo showed us that prices don't necessarily need to ever drop, we've now learned that waiting 1-3 years does carry some risk that prices increase. This generation is just bizarre in all the wrong ways.

The factors are largely external. Covid and Russia-Ukraine war causing inflation led to the first price increase in 2022.

Then we get Trump's tariffs increasing hardware prices, AI boom causing a RAM crisis, war on Iran causing a worldwide fuel crisis which impacts the cost of everything.

Gaming doesn't exist in a vacuum. The last few years have been a shitshow and lot of it was definitely avoidable.

For sure. No disagreement on the external factors doing a lot of this. Where I have to gently push back however is on two fronts:

1. The pandemic definitely caused some issues: asynchronous development was a big issue and really complicated timelines and affected game quality. At the same time, when it comes to price hikes, it's really difficult to know what was genuine necessity and what was taking consumers for a ride. The pandemic brought about "stag-flation" which was increasing prices and stagnant wages, which was a problem caused by supply chain constraints. There was also "Greed-flation", where companies that were slightly affected or had no issues took advantage of the situation and squeezed everyone citing supply chain issues when there were none.

2. It's definitely true that the tariffs, AI boom, and RAM crisis were all things enabled by tech broligarchs throwing money at this caricature of a world leader, one of them being Satya Nadella. I don't think Sony and Nintendo have contributed much to this problem if at all, but Microsoft's Nadella I feel was instrumental in causing every one of those issues. Microsoft as a company contributed to both candidates (though they gave Harris 4x as much if I recall), but Nadella was all in on letting AI run wild. He paid for unregulated AI, and got a war that's not a war (even though Trump called it that at least five times on television) that screwed up helium access. So for me, I feel that one of the players in the gaming industry is a key architect of these issues, and for that reason I struggle a bit to think of it as "external".

A good start would be to release games to go with the console. My Xbox Series X has gathered dust virtually from launch. My advice would be to ditch a next console and release games on PC, PlayStation and Switch. Another idea would be a hybrid console based on Xbox Series X tech and go the same route as Nintendo. Another idea would be to pull out of gaming altogether. Plenty of options there.
