Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

If the 3DS and the next handheld keep selling at the rate they are right now? Never. While Nintendo does love money (like everyone) they realize that once they develop games for non-Nintendo devices it'll likely ruin the entire hardware part of the company (why buy a Nintendo console when you can just play the games on your iPhone? Besides soon they'll just develop for Xbox, right?) and they'll become just another EA or Activision, or worse another Square Enix, Capcom, or Sega--all of which have been going through awful times recently.
No if they did anything mobile they should create there own platform and then leave the core games for their handhelds.
