Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

Nintendo has to be the greatest gaming company left on Earth. The gaming industry would be lost without them pushing innovation and keeping gaming about what it was always primarily suppose to be about. Fun.
I loved my Gameboy and Gamecube, sooooo much and I still have them too. I would love it if they brought the GBA and Gamecube games to the virtual console. That was my favorite console generation. It was when modern gaming hit its stride and still had not become bloated with over inflated budgets and an over focus on making money.
