Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

Personally I really wish they would limit how many people can be in community.
Because You can only see the community if you get invited,and even then people may not actually be playing in that community when you get online.
Which means basically that you're best best bet is either to hope people are playing in a community your in or play randoms.
Which because communities have no limit no one really plays randoms my advice is to limit the community or make it so people can see the community even if not invited.
How to handle the second thing is if someone wants to join a community the active players
vote to let them in and if they decide to let that person in and that person does something that community doesn't like,like glitch abusing then they can ban that user from entering there community.
